1.Foreword

ECOTEC S.à r.l. attaches great importance to respecting your privacy and is aware of how much it matters to you.

ECOTEC therefore does everything possible to ensure that you can use the services offered on this website with complete confidence, in particular by processing your data transparently, in strict compliance with the laws and regulations applicable to the protection of personal data, and in accordance with your own preferences.

3.When is your data collected?

While you use this website, ECOTEC may collect your personal data at various times, when:

  • you browse the pages of the website,
  • you subscribe to our information services (newsletter, notifications, etc.),
  • you contact us (Contact section).

ECOTEC ensures that it only collects the data strictly necessary to provide the services you wish to use.

4.Purposes of processing

The personal data collected is processed for the following purposes:

  • to provide you with the service or information requested,
  • to compile traffic statistics and analyses in order to improve the quality of the services offered,
  • to inform you about the services and offers of ECOTEC and its partners, if you have subscribed to these information services,
  • to send you marketing messages, provided you have given your consent,
  • to secure access to your data and detect any attempted intrusion into our IT systems,
  • to manage your feedback through the surveys you take part in.

For each purpose, the processing of your data has a legal basis:

  • the performance of a contract between ECOTEC and you, or of pre-contractual measures taken at your request,
  • compliance with a legal obligation to which ECOTEC is subject,
  • your consent,
  • a legitimate interest of ECOTEC (fraud prevention, data and infrastructure security, etc.).

If your data is subsequently processed for a purpose other than the one originally intended, you will be given the necessary information beforehand and may object to it.

5.Type of data collected

Your personal data means any information relating to you as a natural person that makes it possible to identify you, directly or indirectly.

The data that ECOTEC may collect is:

  • basic identification data: surname and first name, postal address, email address, telephone numbers, etc.,
  • technical connection and browsing data: IP address, date and time of connection, pages visited, browser and device characteristics, cookies, etc.,
  • geographical location data,
  • publication data: interests, opinions, comments, ratings and messages posted via the website's community features.

Some information is mandatory to achieve the purposes described, other information is optional. You are informed at the time of collection whether it is mandatory or optional. If mandatory fields are not completed, ECOTEC may be unable to provide the service concerned.

6.Recipients of your data

The data collected on this website is intended exclusively for ECOTEC's use. It may, however, be passed on:

  • to processors engaged by ECOTEC to perform its services (hosting and IT operation of the website, sending the newsletter, managing and handling your requests),
  • to business partners, provided you have agreed to receive their communications.

ECOTEC may also be required to disclose data to a third party at the request of judicial or administrative authorities empowered by law. Your data is not passed on to any other third party.

ECOTEC ensures that any disclosure to authorised third parties does not involve a transfer to a country outside the European Union.

7.Retention periods

Your data is kept only for as long as is strictly necessary for the purpose of the processing, or to comply with a legal obligation. ECOTEC therefore keeps:

  • a maximum of 3 years from the end of the business relationship for data processed for business development, marketing and promotional purposes,
  • a maximum of 10 years from the end of the business relationship for data relating to contractual matters (contracts, warranties, claims, debt collection and disputes) or accounting (invoices, purchase orders, delivery notes).

8.Protection of your data

ECOTEC implements appropriate and reasonable security measures in view of the risks presented by the processing, in order to protect your data against destruction, loss, alteration, unauthorised disclosure or access, and any other form of unlawful processing.

All ECOTEC employees and processors who have access to your data in the course of their duties are bound by strict professional confidentiality. They only access the data necessary for their task and are regularly trained in compliance and security rules.

9.Chat assistant

Our website uses a conversational agent powered by artificial intelligence, operated by the Godia solution (GODIA.AI), acting as a processor on our behalf.

When you use this chat, the information you enter (messages, any contact details such as your name, email address or phone number, files you send) is processed in order to answer your questions and, where applicable, to contact you back at your request.

This data is kept for a maximum of 365 days, after which it is deleted or anonymised.

In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, erase and object to the processing of your data. To exercise these rights, contact us using the details provided in this policy. Please do not share sensitive data (health, opinions, etc.) via the chat.

10.Your rights

Insofar as ECOTEC processes your personal data, you have the following rights at any time, within the limits set by law:

  • to access your data, obtain a copy of it, request its correction if it is inaccurate or incomplete, and its deletion if it is out of date,
  • to object to the processing of your data on legitimate grounds (in particular for marketing purposes),
  • to request the restriction of processing or permanent erasure (right to be forgotten), where the conditions are met,
  • to request the portability of the data you have provided, in a structured format,
  • not to be subject to a decision based solely on automated processing, including profiling,
  • to withdraw your consent at any time for processing based on it.

To prevent identity theft, a copy of both sides of a valid identity document must be enclosed with your request. ECOTEC undertakes to reply within a maximum of one month of receiving your fully completed request.
